spearheaded multiple web-based initiatives, including the development of The Chub App, a

workers across the tech, healthcare, and business development sectors.

6. On Balance Discretionary Evidence
In considering “on balance” discretionary evidence, USCIS may evaluate factors
such as: whether, in light of the nature of the foreign national’s qualifications or proposed
endeavor, it would be impractical either for the foreign national to secure a job offer or for
the Applicant to obtain a labor certification; whether, even assuming that other qualified
U.S. workers are available, the United States would still benefit from the foreign national’s
contributions; and whether the national interest in the foreign national’s contributions is
sufficiently urgent to warrant forgoing the labor certification process. Matter of Dhanasar,

would only hinder the advancement of AI-driven productivity enhancement tools designed
to address remote work challenges, including digital fatigue, motivation loss, and
fragmented workplace tool integration.
In the case at hand, the evidence is clear – Olamide David Olufade will be engaged
in an entrepreneurial endeavor that will specifically not adversely affect American workers
because Olamide David Olufade is not competing for jobs – he is creating them.
▪ Even Assuming that Other Qualified U.S. Workers are Available, the United States
Would Still Benefit from Olamide David Olufade’s Contributions
As previously discussed, granting Olamide David Olufade a national interest waiver
will not adversely affect American workers because of the entrepreneurial nature of the
proposed endeavor. The record of evidence shows that Olamide David Olufade is a highly
qualified immigrant entrepreneur whose work in the HR technology and productivity
software industry holds substantial merit and national importance, particularly given the
technological implications of his proposed endeavor. The Chub App addresses critical
challenges in remote workforce productivity and mental well-being, leveraging AI-driven
analytics and engagement strategies to enhance workplace efficiency. By fostering
innovation in HR technology and supporting economic development in an underserved
region, Mr. Olufade’s endeavor aligns with national priorities of workforce optimization
and technological advancement, demonstrating a clear benefit to the U.S. economy without
displacing American workers.
Olamide David Olufade submits that his case is substantially similar to that of
Dhanasar, where the BIA found that the Applicant’s proposed endeavor of engaging in
research and development relating to air and space propulsion systems was of national
importance because it enhanced national security and defense. Dhanasar, 26 I&N. at 892.

Applicant in Dhanasar, given the economic impact of his proposed endeavor and its
